Agreement to Terms
By accessing or using the website at growthlabhq.ca (the "Site") and any services offered by Growth Lab ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Site or our services.
Services
Growth Lab provides marketing, creative, and related digital services as described on the Site or in separate agreements. Specific scope, fees, and deliverables are governed by proposals, statements of work, or contracts you enter into with us. Nothing on the Site guarantees particular results; performance depends on many factors outside our control.
Use of the Site
You agree to use the Site only for lawful purposes. You may not misuse the Site, attempt to gain unauthorized access to our systems, scrape content in violation of these terms, or interfere with other users' experience. We may suspend or terminate access if we reasonably believe you have violated these terms.
Intellectual Property
The Site and its content (including text, graphics, logos, and design) are owned by Growth Lab or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as allowed by law.
Disclaimer
The Site and its content are provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent permitted by law, Growth Lab and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or our services. Our total liability for any claim relating to the Site shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater, if you have not paid us.
Indemnity
You agree to indemnify and hold harmless Growth Lab from claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your violation of these terms, or your violation of any third-party rights.
Governing Law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Quebec for disputes arising from these terms or the Site, subject to mandatory consumer protections where applicable.
Changes
We may update these Terms & Conditions at any time. We will post the revised version on this page and update the "Last updated" date. Continued use of the Site after changes constitutes acceptance of the revised terms.
