Client Engagements

If you engage GrowthLab for marketing services, the following general terms apply unless otherwise specified in a separate written agreement:

• Service Agreements: All engagements are governed by a separate service agreement or proposal that outlines the scope of work, deliverables, timelines, and fees.
• Payment Terms: Fees are due as specified in the applicable service agreement. Late payments may be subject to interest or suspension of services.
• Results Disclaimer: Marketing results depend on many factors outside our control, including market conditions, competition, product quality, and audience behavior. GrowthLab does not guarantee specific results, outcomes, or return on investment from any campaign or service.
• Client Responsibilities: Clients are responsible for providing accurate business information, timely feedback, and any access or assets required to deliver the agreed services.

Third-Party Platforms

Our services often involve managing campaigns on third-party platforms such as Google Ads, Meta (Facebook/Instagram), and others. Please note:

• These platforms have their own terms of service and policies that govern your use.
• GrowthLab is not responsible for changes to third-party platform policies, algorithms, pricing, or availability.
• Any accounts on third-party platforms remain the property of the client unless otherwise agreed.

Text Messaging Program

By providing your phone number and checking the corresponding SMS consent boxes on our contact form, you agree to receive text messages from GrowthLab in line with the consent you gave:

• Non-marketing messages about your inquiry, scheduled consultations, and service updates.
• Marketing messages about special offers, case studies, and service updates.

• Frequency. Message frequency varies depending on the program you opted into and your interaction with us.
• Cost. Message and data rates may apply, based on your mobile carrier and plan.
• Opt-out. Reply STOP to any message at any time to unsubscribe. You will receive one final confirmation, after which no further messages will be sent. You may also opt out by emailing info@growthlabhq.ca.
• Help. Reply HELP to any message for support information, or email info@growthlabhq.ca.
• Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction) and either the account holder of the mobile number you provide, or have authorization from the account holder.
• Carriers. Supported on all major US and Canadian carriers. Carriers are not liable for delayed or undelivered messages.
• No purchase required. SMS consent is not a condition of any purchase or service.

GrowthLab does not share SMS opt-in data with third parties or affiliates for their own marketing purposes. See our Privacy Policy for details.

Limitation of Liability

To the fullest extent permitted by law:

• GrowthLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
• GrowthLab shall not be liable for any loss of profits, revenue, data, or business opportunities, whether direct or indirect.
• Our total liability for any claim arising from or related to our website shall not exceed the amount you paid to GrowthLab in the twelve (12) months preceding the claim, or $100, whichever is greater.
• GrowthLab is not liable for any actions, policy changes, or account suspensions imposed by third-party advertising platforms.

Indemnification

You agree to indemnify, defend, and hold harmless GrowthLab, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our website, violation of these Terms, or infringement of any third-party rights.

Disclaimers

• Our website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
• We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

Termination

For client service engagements, termination terms are governed by the applicable service agreement.

Severability
